With the arrival of a new year, it is important that all of us take a look back at one of the most possibly-tragic events in the state of Texas. When three workers fell off a shaky scaffold on that fateful but severely fortunate day, June 24, 2011, OSHA's Austin Area Office initiated an investigation on following a report that a third-floor balcony had collapsed at a construction site. The three employees who fell 16 feet to the ground, only suffered minor injuries and were treated and released from a local Austin hospital.

The fact that the workers only sustained minimal non-life threatening injuries was a miracle unto itself, but the truth and the facts remain that construction firms have an unwavering responsibility to make certain the entire crew is properly OSHA safety trained. The company, Martin's Concrete Construction of Austin, was fined $143,880 and was cited for numerous OSHA errors and omissions. OSHA has cited the construction company for serious and repeat safety violations following the incident and has been very tough on the owners of the construction company, as well they should.

OSHA has cited Austin-based Martin's Concrete Construction for eight serious safety violations, including failing to develop a safety and health program, provide employees with safety and health training, ensure that shoring was designed by a qualified designer, and provide fall protection such as guardrails when working on projects at levels higher than 6 feet. Proposed penalties total $28,800. "Failure to effectively implement OSHA's safety and health standards to protect workers from potential workplace hazards can lead to serious or fatal injuries," said Casey Perkins, OSHA's area director in Austin. "If the company had installed the proper shoring, it is possible these injuries could have been avoided."

Onsite Training Update 2012 - OSHA 30 Hour Construction

In the news this past year, there was a rather obscure posting about OSHA citing a masonry contracting company in Austin, Texas. OSHA30 Hour Construction courses onsite training would have been able to dodge this disciplinary action by the Department of Labors Safety and Health wing, OSHA.

The problem with Arreola Masonry and the cause of the citation, stemmed from serious and repeated violations for exposing workers to scaffolding hazards. The total number of safety citations, which were delivered to the owners of this concrete firm, stands at a whopping six. Three were considered very serious and three were related to the repetitive violations that could have cost a man or woman their very lives.

The firm was reported as being cooperative and remorseful after the green-shirted OSHA inspectors doled out their punishments for exposing workers to fall hazards at the company's work site in Cedar Park. Proposed penalties total $46,200 and should be a firm penalty phase and hopefully with correct the faulty, inferior scaffolding, at the numerous work-sites.

If North Dakota Coal Ash is Deemed a Hazardous Waste - Hazwoper 40 Hour Courses Will Be Required for All Contact Workers

In the state of North Dakota where coal ash is collected from the Great River Energy's Coal Creek electric power station near Underwood and shipped all over the United States, there is an issue. The issue at hand is one that threatens to make all of the construction workers, or anyone else that handles this black stuff, wear a moon suit. Yes, that’s right, the simple coal ash that has been dealt out in tons and as a fine concrete replacement can soon be labeled a hazardous waste, if ND Senator Hoeven has his way.

Conrad Thune Hoeven

The great state of North Dakota has a team of politicians that are; Sen. Kent Conrad, D-N.D., and Sen. John Thune, R-S.D., that are among the measure's sponsors. Hoeven held a news conference Tuesday to promote the legislation in a Bismarck State College building that was built from cement that included coal ash. If these politicians have their way, it will be a windfall for the sites that offer Hazwoper 40 hour courses.

EPA Involvement

The federal Environmental Protection Agency is considering a proposed rule that would classify the ash as hazardous waste, which would increase the cost of disposing of it. North Dakota does not have a landfill that takes hazardous waste, said Steve Tillotson, assistant director of the North Dakota Health Department's waste management division.

Environmental Opposition

Environmental groups oppose Hoeven's measure, saying that tougher disposal standards for coal ash are needed because the ash contains lead, mercury, cadmium and other heavy metals. A catastrophic December 2008 spill from a coal ash disposal pond in eastern Tennessee gave supporters of stronger rules a fresh argument that they were needed.

Regulation of Coal Ash

Hoeven said his bill would allow states to regulate coal ash disposal and recycling if they followed federal solid waste standards. States that do not want to administer their own programs could rely on the EPA to do so, Hoeven said.

ND Coal Industry Supports Regulation

North Dakota's coal industry is supporting Hoeven's proposal. The state has seven coal-fueled electric power plants and a factory that produces synthetic natural gas from lignite coal. The state's lignite mines in west-central North Dakota produce close to 30 million tons of fuel annually.
